Terms of Use

Any use of a web site or its contents or both (collectively: "Web Site") hosted by Dalhousie University ("Dalhousie") is subject to the following terms and conditions. Use of a Web Site hosted by Dalhousie is conclusive evidence that the user has read, understood, and accepted the following terms and conditions. If you do not want to accept the following terms and conditions, do not use a Web Site hosted by Dalhousie.

Copyright / permission to reproduce

Materials on the Web Site were produced and/or compiled by Dalhousie for the purpose of providing visitors with direct access to information about the programs and services offered by Dalhousie. 

The material on the Web Site is covered by the provisions of the Copyright Act, by Canadian laws, policies, regulations and international agreements. Such provisions serve to identify the information source and, in specific instances, to prohibit reproduction of materials without written permission.

Acceptable use policy

You agree that you have read, understood and accepted, and that your use of any Web Site shall comply with, the terms of Dalhousie’s Acceptable Use Policy.

Disclaimer

Although care has been taken in preparing the information contained in the Web Site, Dalhousie does not and cannot guarantee its accuracy. Anyone using the information on this site does so at his or her own risk; any loss arising from the use of information on this website is the sole responsibility of the user. You expressly accept that Dalhousie is not responsible for and expressly disclaims any responsibility, whether express or implied, for the accuracy, adequacy, or completeness of the Web Site or for the consequences, whether direct or indirect and whether known or unknown, of using the Web Site. Dalhousie will not be responsible for any injury or damage arising from its use. 
 
You expressly accept that Dalhousie does not assume any responsibility for the uninterrupted or error free operation of the Web Site or warrant or represent that the Web Site is free of viruses or other harmful components.

Forums and content submissions

By uploading materials to any chat board or forum available on a Web Site (collectively "Forums") or otherwise submitting any materials to us through any other content generating or submitting service on a Web Site, you automatically grant (or warrant that the owner of such materials expressly grants) Dalhousie a world-wide, perpetual, royalty-free, irrevocable and non-exclusive right and license to use, copy, adapt, transmit, communicate, publicly display and perform, distribute and create compilations and derivative works from such submitted materials, for the purposes of publishing and promoting such materials in connection with the Forum or other service through which the materials were submitted or generated, and for all promotions thereof. Such license shall apply with respect to any form, media, or technology now known or later developed. In addition, you warrant that all "moral rights" in such materials have been waived. 
 
You agree that all materials, including information, data, text, software, music, sounds, graphics or video ("Content") whether publicly posted or privately transmitted, are the sole responsibility of the party from which such Content originated. You agree that you will not upload, post, transmit or otherwise make available any Content that  infringes any patent, trademark, trade secret, copyright or other proprietary right of any party. 
 
If you are a minor, you must have permission from your parent or guardian to upload any materials to a Forum. Dalhousie may request a parent's or guardian's email address from anyone who uploads any materials to a Forum for the purpose of verifying with the parent or guardian that he/she has in fact given permission for such uploading. In the event that material is uploaded without permission, all uploaded material will be removed immediately and without notice to you. 
 
When participating in a Forum, never assume that people are who they say they are, know what they say they know, or are affiliated with whom they say they are affiliated. Dalhousie cannot be responsible for the content or accuracy of any information, and will not be responsible for any reliance or decisions made based on such information. When using a Forum, you may not post, transmit, link to, or otherwise distribute any information, materials or content that do not generally pertain to the designated topic or theme of the particular Forum. Use of a Forum for commercial purposes of any kind is strictly prohibited. Please note that Dalhousie reserves the right to refuse to post or to remove any information or materials, in whole or in part, that, in its sole discretion, are unacceptable, undesirable, or in violation of these Terms and Conditions.

Monitoring

You agree that Dalhousie has no obligation to monitor a Web Site or any content accessible through a Web Site or any of the services. However, you agree that Dalhousie has the right to monitor a Web Site electronically from time to time and to disclose any information as necessary to satisfy any law, regulation or other governmental request, to operate a Web Site or any of the services properly, or to protect itself or its users in accordance with the Privacy Statement.

Content linked to a web site

Please note that certain links on a Web Site may take you to other websites. Dalhousie provides these links only as a convenience and not as an endorsement by Dalhousie. These linked sites are not necessarily under the control of Dalhousie. If you decide to visit any linked site, you do so at your own risk and it is your responsibility to take all protective measures to guard against viruses and other destructive elements. Dalhousie is not responsible for the content of any such linked sites or any other web page which is not part of a Web Site and under Dalhousie's control. Unless otherwise expressly provided, Dalhousie makes no representation or warranty regarding, and does not endorse, any linked site or the information, products or services appearing thereon. Accordingly, you agree that Dalhousie will not be responsible or liable in any way for the accuracy, relevancy, copyright compliance, legality, or decency of material contained in any site linked from a Web Site, or for the consequences, whether direct or indirect and whether known or unknown, of using any link from the Web site to another web site or its contents.

Governing law and jurisdiction

You expressly agree that any disputes, claims, complaints or actions you may choose to advance arising from your use of the Web Site will be decided by the Courts established under and applying the laws of Nova Scotia excluding the law relating to choice of law and forum conveniens. You further expressly agree that you have attorned to the jurisdiction of the Courts of Nova Scotia for the purpose of resolving any such dispute, claim, complaint, or action.
